Whistleblower Protection Act

The California Whistleblower Protection Act prohibits retaliation against state employees or applicants who report suspected improper governmental activities. Retaliation may include intimidation, denial of employment or promotion, negative performance evaluations, involuntary transfers, or disciplinary action.n.

Reporting Improper Governmental Activity or Significant Threats to Health or Safety

At Ä¢¹½ÊÓÆµ (CSUEB), the Associate Vice President of Risk Management and Internal Control has been designated by the campus President to receive and review whistleblower submissions in accordance with California State University (CSU) Executive Order 

Current employees, former employees, and applicants for CSU employment may submit reports via email to  whistleblower@csueastbay.edu

Under CSU , Improper Governmental Activities includes actions that:

  • Violate state or federal law (e.g., fraud, theft, misuse of public resources);
  • Involve waste, gross misconduct, or abuse of authority; or
  • Present significant threats to health or safety, including unsafe practices or substantial risks of harm. 

Retaliation Complaints

In accordance with CSU , the University reviews complaints alleging retaliation for making a protected disclosure in good faith. A complaint may be filed if an employee, former employee, or applicant believes adverse action was taken because they reported improper governmental activity.

Examples of retaliation may include:

  • Termination or denial of employment;
  • Demotion, reassignment, or denial of promotion;
  • Unjustified negative evaluations or disciplinary action;
  • Harassment, intimidation, or threats; or
  • Other adverse actions that would discourage a reasonable person from reporting misconduct.

This process fulfills the requirements of the California Whistleblower Protection Enhancement Act ().

 

  • Filing a Complaint – EO 1115

    Under , any employee or third party may file a complaint alleging Improper Governmental Activities. Complaints must be submitted within 12 months of when the individual knew or reasonably should have known of the alleged activity.

    Complaints are encouraged to be submitted in writing and may be filed at the campus, systemwide, or state level. The  may be used.

    Information to Include

    • Your contact information (i.e., mailing/email address, and phone number) and CSU affiliation (e.g., CSU position title or if there is a third-party relationship with the CSU) if applicable;
    • Description of the alleged improper activity, including names, titles, and dates;
    • If known, names and contact information of potential witnesses; and
    • Any supporting documentation or description of relevant records.

     

     

  • Filing a Complaint – EO 1116

    prohibits retaliation against employees, former employees, or applicants for making a protected disclosure. Retaliation complaints must be submitted within 12 months of the most recent alleged retaliatory act and must include a Sworn Statement.

    Employees may report retaliation to their Supervisor or Manager, who must immediately forward the complaint to the Associate Vice President of Risk Management and Internal Control.

    • Description of the original protected disclosure, including dates and individuals involved;
    • Description of the alleged retaliatory action (dates, individuals, and explanation of retaliation);

    • A dated sworn statement under penalty of perjury.
